Terms of Service
These Terms of Service ("Terms") govern your use of the domain registration and management services provided by Domain Pool. By accessing or using our services, you agree to be bound by these Terms.
Scope
These Terms apply to all users of our websites, products, and services. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
1. Account Registration
To use our services, you may need to create an account. You are responsible for providing accurate information, keeping your account credentials secure, and promptly updating your details when they change. You are responsible for all activity that occurs under your account.
2. Acceptable Use
You agree not to misuse our services. You must not:
- Violate any applicable law or regulation.
- Infringe the rights of others.
- Attempt unauthorized access to accounts, systems, or data.
- Interfere with the operation, integrity, or security of the service.
- Use the service to transmit malware, spam, or abusive content.
- Scrape, reverse engineer, or exploit the service except where allowed by law.
- Submit false, misleading, or fraudulent registration information.
We may suspend or terminate access if we reasonably believe these rules have been violated.
3. Domain Registration and Ownership
When registering a domain through Domain Pool, you agree to comply with the policies and requirements of the applicable registry, registrar, or governing authority. You are responsible for ensuring that your chosen domain name does not infringe on third-party rights or violate applicable law. Domain registration, renewal, transfer, and cancellation may be subject to third-party registry rules.
4. Billing and Payment
Domain registration and related services are subject to the fees shown in our pricing and checkout flows. You agree to pay all applicable fees and taxes at the time of purchase unless otherwise stated in a separate written agreement. Failure to make payment may result in suspension, cancellation, or loss of your registered domain names, subject to applicable registry rules.
5. Service Availability and Changes
We may modify, suspend, or discontinue any part of the service at any time, with or without notice, to the extent allowed by law. We do not guarantee uninterrupted availability, error-free operation, or that the service will meet every need or expectation. We may also introduce, change, or remove features from time to time.
6. Third-Party Services
Our services may rely on or integrate with third-party providers, including registries, registrars, payment processors, hosting providers, analytics providers, and support tools. Those third parties operate under their own terms and privacy practices, and we are not responsible for their acts or omissions except where required by applicable law or a separate written agreement.
7. Data and Support
If you contact support, submit a form, or use the service in a way that generates records, we may retain and use those records to provide support, operate the service, and meet legal obligations. If you are an enterprise customer and have a separate data processing agreement or master services agreement, that agreement may control to the extent of any conflict.
8. Termination
We may suspend or terminate your access immediately if we believe you violated these Terms, created risk, or used the service unlawfully or abusively. You may stop using the service at any time. Certain obligations, including payment obligations, indemnification, limitations of liability, and any rights or licenses that by their nature should survive, will survive termination.
9. Intellectual Property
We and our licensors own the service, software, branding, and other content we provide, except for content you submit or third-party materials. You may not copy, modify, distribute, or create derivative works from our content except as expressly permitted by law or written agreement.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
11. Limitation of Liability
To the maximum extent permitted by law, Domain Pool will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from or related to your use of the service. To the extent liability cannot be excluded, it will be limited as required by applicable law or by a separate written agreement if one applies.
12. Indemnification
You agree to indemnify, defend, and hold harmless Domain Pool, its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of the services, your content, your violation of these Terms, or your violation of applicable law or third-party rights.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws applicable to the agreement between you and Domain Pool, without regard to conflict-of-law principles. Any dispute resolution procedures, venue, or arbitration requirements will be governed by the written agreement in effect for your account, or by applicable law if no separate agreement applies.
14. Changes to These Terms
We may update these Terms from time to time. When changes are material, we will post the updated Terms on this page and update the effective date if applicable. Your continued use of the services after changes become effective means you accept the revised Terms.
